NBN23 S.L. processes your personal data when you use our applications or our website.   1. WHAT DATA WE COLLECT AND PROCESS

General. NBN23 S.L. processes personal data that you, as a user of the Products, make available to us, for example, through the use of our Products, and that other users provide to us (“Data”).

Categories of Personal Data.

These are the categories of Personal Data that we collect directly or indirectly from you:

Identity information: Includes your name (first name, last name), date of birth, email address, gender, profile picture, social media identifiers and information transmitted to us through your Facebook or Google or Instagram account. We use this information to verify your identity.

Contact Information: This includes your phone number, shipping and billing mailing address, email address, Messenger ID, social media nickname, and any other communication channels you use to contact us for more information. We use this information to contact you for various reasons depending on the purpose.

Location information: This includes your place of residence, current login location (IP address), GPS location (if you wish to share it with us; for example, through your mobile device settings), or the particular NBN23 S.L. site you have visited that may give us clues as to where you are. We use this information to manage our products and tailor your product experience to your location.

Size information: This includes your shoe size, clothing size, height, weight, chest, waist and hip circumference, calf circumference, waist and hip circumference, calf length, body shape, and toe to heel measurement. We use this information to manage our products.

Community information, information you provide to us when you participate in various NBN23 S.L. events and communities/groups (e.g., pictures, videos, your team, your interests and preferences, your comments, rankings, event participation, groups you belong to, and registration data).

If you explicitly allow us to access your phone book, we will compare the e-mail addresses of your contacts with those of registered users of NBN23 S.L. and send you a list with suggestions for friendship. We do not store this information.

We use Community Information to manage our products, organize events and communities, and connect you with other members of your communities.

Social Media Information: Includes information obtained through your interaction with us on various social media channels such as Facebook, Instagram, Google, etc. (e.g., all publicly available social media information, such as social media nicknames, social media interactions and public posts, your “likes” and other reactions, your social media connections, your public photos, or those you send us by mentioning or following our social media posts using “nicknames” or “hashtags”). Social networks (e.g., Facebook, Snapchat, Instagram, etc.) provide this information to us directly, or we obtain it indirectly through third party agencies with whom we have agreements.

Device Information: Includes device or browser information that gives us insight into your browsing behavior or device usage. Our applications collect information from your device, while our cookies, tags and tracking pixels allow us to collect information from your browser. This information is often necessary to ensure network security. This includes, but is not limited to: IP address, date and time of visit, time spent on our website, volume of data transmitted, originating URL (whether you came to our website from another website or from an advertisement), pages visited on our website, browser type (including browser language and version), browser plug-ins, device identifier, device type, versions and operating system.

Activity information: Includes physical exercise data (e.g., exercise start and end time, activity type, sport category), sensor data (e.g., targets, duration, pace, distance, calories, heart rate and speed), nutritional information (e.g., time, calories, food information [name, type, macronutrients, micronutrients]) and other data (e.g., routes and photos including location data) related to your physical activity tracking application. We use this information to manage our products and help you improve your performance goals and user experience, as well as to identify products that may be better suited to you based on your physical activity patterns.

Preference information: This includes information such as your preferred language, the location from which you log in, the units you want to view (distance, weight, temperature), your personal goals and motivations (e.g., weight goal), training plan information (e.g., start date, training plan and associated physical activities), sports equipment information. We use this information to facilitate your visit/purchase on our websites and apps.

Registration via Facebook or Google

If you register an NBN23 S.L. account via a social network login, we will receive the following information:

Facebook friends list

We will receive the data of your Facebook friends if you explicitly allow us access to them. We will use this information to make friendship suggestions on the Products, but we will not store it.

  • Use of the Service

Google Analytics

This Website uses Google Analytics, a web analytics service provided by Google. Google Analytics uses cookies. Please see our Cookie Policy for more information about cookies and how to opt out of their use. We use Google Analytics to analyze and continually improve the use of our Products. The Products use Google Analytics in conjunction with the “_anonymizeIP()” option. This means that IP addresses are processed in a shortened format to avoid the transmission of personal data. The legal grounds for processing the Data are our legitimate interests.

Firebase and Google Analytics for mobile applications

General. For iOS and Android apps, we use Firebase from Google (https://firebase.google.com/docs) and Google Analytics for mobile apps (https://developers.google.com/analytics/solutions/mobile). User data is transmitted anonymously to Google. Our Apps use mobile device identification, including Google Advertising ID (“GAID”) and iOS Advertising ID (“IDFA”), as well as cookie-like technologies for running Analytics for mobile services.

Purposes. We use Firebase and Google Analytics to analyze and continually improve the use of our Products. By using statistics, we improve our services and make them more interesting for users.

Event tracking by NBN23 S.L.

WHAT WE PROCESS THE DATA FOR (“PURPOSES”) AND ON WHICH LEGAL BASIS

On the legal basis of the consent of the person concerned given by ticking the corresponding box in the registration process, the personal data provided by the person concerned in the registration will be communicated to third parties with related interests in order to improve the user experience and assist the user in the practice of sports, below, we detail the purposes of processing of your personal data:

  • Operation of the Products. NBN23 S.L. processes your Data in order to provide you with a smooth user experience when using the Products.

Provision of services. In order to manage the Products and provide the Services, in addition to

  • authenticate your access to an account;
  • to display and track your activity
  • to show your progress and training statistics.

Global credential for all NBN23 S.L. platforms. We know you don’t like having to remember usernames and passwords, or having to log in multiple times. To enable our users to access all platforms, portals, services, communities and applications operated by the Data Controllers we store your NBN23 S.L. Login Credentials on the NBN23 global authentication platform. When you use your NBN23 S.L. Login Credentials to access any NBN23 S.L. Platform. Platform, we will use a code to verify your identity on the NBN23 S.L. global authentication platform. In addition, this measure further protects our networks and domains. The legal grounds for processing the Data are our legitimate interests.

Contacting friends. To facilitate the tasks of searching and connecting with other people. We may use the information you have shared with the Products, including GPS data, to suggest connections between you and people you may know. For example, we may associate information we learn about you from your and your friends’ use of the Products, and from information you and other users provide, to suggest people you may know or want to contact through our Products.

Research and Development. We process Data, including public feedback, to conduct research for the further development of our Products, to provide you and other users with an improved, more intuitive and personalized experience, and to drive user growth and engagement with our Products.

In particular, we will use your Personal Data, among other purposes, to:

  • provide you with access to special offers and promotions;
  • send you invitations to exclusive events;
  • give you access to limited edition products;

You will receive marketing emails from NBN23 S.L.

When you use the NBN23 S.L. Apps NBN23 S.L. uses in-app push notifications to provide you with information about your subscription or promotional activities and offers. You can turn off push notifications at any time from the “Settings” on your mobile device. However, if you disable push notifications, NBN23 S.L. may need to contact you via email to send you important messages related to your subscription. The legal basis for the processing of your Personal Data is the performance of the contract.

General marketing. We process the Data to provide you with (tailored) promotional material about NBN23 S.L.’s online products and services.

Email marketing/push messages. With your consent, NBN23 S.L. will send you marketing messages by email or push messages with information about its activity as well as about products of interest to you. With your consent, NBN23 S.L. shares your personal data with third parties for personalization purposes, and vice versa.

We inform you that we evaluate your reading behavior with the help of so-called web beacons or tracking pixels. The information created by these markers is linked to the information obtained about the categories explained in section 3.2 Personal Data Categories, your e-mail address and an individual ID. NBN23 S.L. uses third-party advertising platforms (such as, for example, Facebook, Google, YouTube, Instagram, Twitter, Snapchat and Pinterest) to send targeted messages to you, based on your behavior and browsing patterns at specific times and places on these platforms, to increase the effectiveness of our advertising campaigns. At NBN23 S.L. we use third party solutions (such as, for example, Google Audience and Facebook Custom Audience) in order to better target our campaigns and messages to our customers. The processing of your Personal Data depends on your marketing consent. You can disable this option at any time in your privacy settings. It may take several days after disabling before you are removed from all audiences.

  • Compliance and enforcement.

Enforcement. If we deem it necessary, we process your Data for security purposes or to investigate possible fraud or any other breach of our Terms and Conditions or this Privacy Policy, or any attempt to cause harm to our members or visitors.

EXCHANGE OF PERSONAL DATA

  • General

We share Data with third parties:

  • if necessary, for the Stipulated Purposes;
  • upon request of a national authority;
  • upon request of a court ruling;

In the event of a lawful request for your Data, we will endeavor to notify you if we deem it appropriate, unless prohibited by law or court order, or in the case of an urgent request. We will refuse such requests when we believe that the requests are too broad or vague, or do not originate from a competent authority.

  • Our services

Your profile. By default, your profile is fully visible to your NBN23 S.L. friends. This means that as soon as you add friends in the Products, they will be able to see your profile, including your participation in groups and events.

News section. Our services allow you to view and share information, including posts, “Like” ratings and comments.

Challenges. These are competitions with a specific goal within a defined time frame. There are different challenges in which registered users can participate with the possibility of winning prizes. You can compare your position with that of all users participating in the same challenge.

Groups and communities. All registered users can create groups and invite other users to these groups, as well as receive invitations to communities. When you are in a group or community, you can interact with other members and compare your post with all users.

Live tracking. The Products include a “live tracking” feature (“Live Tracking”), which allows NBN23 users to follow basketball games of interest to them.

  • Services you may use. NBN23 S.L. allows you to connect to third party services. For example, to connect other accounts to your NBN23 S.L. profile or to share your activities with friends.

Social networking and messaging services. You may choose to share completed activities on Facebook, Twitter, WhatsApp, Instagram, Telegram or any other messaging service you use on your mobile device. Please note that we do not influence the Data, and we do not know its scope and further use by the messaging service, and we cannot assume any responsibility for the relevant messaging provider’s use of your Data. Please refer to the applicable messaging service’s privacy policies for more information.

  • Service Providers

Service Providers. We share your information with other service providers who help us provide and improve our Products (for example, in connection with maintenance, analysis, audits, payments, fraud detection, marketing and development). Service providers will have access to your information to the extent reasonably necessary to perform these tasks on our behalf, and are required not to disclose or use it for other purposes. We use service providers such as Adjust, Google, Facebook, Amazon Web Services, Inc., Emarsys eMarketing Systems AG, Pushwoosh, Inc, NewRelic, Inc, Apptimize, Inc. or Zendesk, Inc.

  • Transfers to third parties

We share your personal data with other data processors of related products or services, complementary or corresponding to the same field or sector.

  • Recipients of personal data. Your personal data may be shared with different organizations.
  • Communication of data to third parties.

Based on the legal basis of the consent of the person concerned given by ticking the corresponding box in the registration process, the personal data provided during the registration in the application relating to the user and his identification will be communicated to related third parties in order to improve the user experience and the promotion of the sport practice.

This means that both we (NBN23 S.L.) and the third parties to whom we communicate your personal data may process your data simultaneously.

However, once NBN23 S.L. has communicated the personal data you have authorized to us to third parties, NBN23 S.L. will not be responsible for the processing of your personal data by such third parties and any communication you wish to send to such third parties, including exercising your data protection rights against them, should be sent to the e-mail and contact addresses published by such third parties.

  1. PERIOD OF CONSERVATION OF THE DATA
  • Retention period. We must retain your Data for as long as you have an account with us. If you are a user within the EU and you stop using our services without requesting deletion of your Data, we will retain it for 25 months from your last interaction with a point of contact of NBN23 S.L. Other than that, we only store Data where legally required (due to warranty, statute of limitations or retention periods) or we have an obligation to do so for other reasons.
  • Account deletion. If you choose to delete your account, all Data that NBN23 S.L. holds about you will be deleted with the following exceptions:
  • Data that you have posted (e.g. comments on the sports activities of other registered users will become anonymous data, i.e. it will be specified that this information was provided by a deleted user).
  • Data necessary for NBN23 S.L. to fulfill contractual obligations or to act in accordance with statutory retention obligations will not be deleted, but will be reduced as far as possible.

A deletion request does not affect the Data in the event that its retention is legally necessary, e.g. for accountability purposes.

YOUR RIGHTS

1. Exercising your rights. To exercise your data protection rights under Articles 15 to 22 of Regulation (EU) 2016/679, please send a request to the Email address or to the postal address.

2. Revocation of consent. In cases where your consent is necessary for the processing of data and you have given it, you may revoke it at any time so that it is not processed in the future. However, this does not affect the lawfulness of the processing of Data under the consent prior to revocation. In certain cases, we may continue to process your information after you have withdrawn your consent if we have other legal grounds for doing so, or in case the withdrawal of your consent is limited to certain processing activities.

3. Right of access. You have the right to obtain (i) confirmation of whether or not we are processing your Data and, if so, to obtain (ii) more specific information about the data. The more specific information relates, among other things, to the purposes of the data processing, the categories of Data, the possible recipients or the retention period.

4. Right of rectification. You have the right to demand that we rectify inaccurate Data relating to you. In the event that the Data we process is not correct, we will rectify it without undue delay and inform you of such rectification. Please note that i) you can rectify much of your information in the settings and ii) technically, we cannot rectify all types of data in our Product.

5. Right of deletion. You have the right to delete the Data we hold about you. If you wish to do so, please go to your account settings and, once there, delete the account. If you are unable to do so, please contact us at the Email Address. As a security measure, we will send you an email to confirm the deletion. Upon confirmation, we will delete your Data. Please note that your phone may retain some Data after account deletion.

6. Right to restrict processing. You have the right to have us restrict the processing of your Data in the following cases:

  1. if you make a request under paragraph 8.4;
  2. if you consider that the processing of your Data is unlawful, but you object to the deletion of the Data;
  3. if you still need the Data for the recognition, exercise or defense of a legal right; or
  4. if you have objected to the processing in accordance with paragraph 7.8.

7.Right to Data Portability. You have the right to (i) receive a copy of your Data in a structured, commonly used, machine-readable format, and (ii) transmit such Data to another data controller without hindrance from us. You may download a copy of your Data in the account settings on the Website.

8.Right to object. You have the right to object at any time to the processing of Data for which the legal basis is our legitimate interests, including profiling under such provisions. You also have the right to object to the processing of Data for direct marketing purposes.

9. You have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects or similarly significantly affects you.

10. Right to lodge a complaint. You have the right to lodge a complaint with a local supervisory authority if you believe that the processing of the Data violates applicable law.

  • OTHER RIGHTS

We inform you that in the event that you have expressly authorized the sending of advertising and promotional communications, newsletters, news and invitations to events by electronic means, pursuant to articles 21 and 22 of the Law on Information Society Services and Electronic Commerce (LSSICE), you have the right to oppose the processing of your data for the sending of advertising or promotional communications, as well as the right to revoke at any time the consent given for this purpose by simply notifying NBN23, S.L. of your desire to do so.

    • Legal Basis. Under data protection law, we are only authorized to collect and process your Data if we have a legal basis to do so. The lawfulness of the Data processing stems from:
      • your (explicit) consent where you have given it for the processing;
      • the need to comply with the user contract, for example, where the Data is necessary for the successful use of the Product; or
      • the legitimate interests of NBN23 S.L. or a third party, such as our use of cookies, plug-ins or targeted advertising.

Our legitimate interests are to protect you, NBN23 S.L. or others from security threats or fraud, comply with all applicable laws, manage and improve our business (e.g., customer service or reporting) with potential corporate transactions (e.g., mergers and acquisitions), enable users to share their experiences.

  • Security Measures. We are committed to safeguarding your Data and implementing appropriate technical and organizational security measures to prevent unauthorized or otherwise unlawful processing of your Data and to prevent any accidental loss, destruction or damage.     • What does NBN23 S.L. do when transferring your Personal Data outside the EU or EEA? Depending on the Personal Data processing activity, your Personal Data is shared with different “Categories of recipients”. For cases where the recipient is located outside the EU or EEA, we have implemented the necessary measures (such as signing the EU Standard Contractual Clauses approved by the European Commission).
